Criminal Record Certificates – Estratto del Casellario Giudiziale
The Criminal Record Certificate is an official document that lists final criminal convictions. Legislative Decree No. 122/2018 merged the criminal record certificate and the civil record certificate into a single judicial record certificate, which also includes information on whether the individual is listed in the European Judicial Record. These certificates, along with their legalization via apostille, can be requested from any Public Prosecutor’s Office (Procura della Repubblica), regardless of the applicant’s place of birth or residence.
The Pending Charges Certificate, on the other hand, lists all ongoing criminal proceedings against the applicant. This certificate and its legalization via apostille must be requested from the Public Prosecutor’s Office at the Court that has jurisdiction over the applicant’s current or past place of residence. However, there are no restrictions on obtaining this certificate from a different Public Prosecutor’s Office, though in such cases, it will only include pending proceedings within that specific court’s jurisdiction.
All these certificates are valid for a maximum of six months from the date of issuance.
Applicants must request these certificates and their apostille legalization (required for use in the United Kingdom) either personally or through an authorized representative at the Public Prosecutor’s Office in Italy.
Some Public Prosecutor’s Offices offer postal application procedures for individuals residing abroad. One example is the Public Prosecutor’s Office in Rome. Applicants are advised to contact the relevant offices directly for detailed information on the process.
